Bucketplay Inc. Privacy Policy

This Privacy Policy applies to Metaball our Free Cross Platform Game (“Metaball”) operated by Bucketplay Inc of 926, U1 Technovalley, 92, Jomaru-ro 385beon-gil, Bucheon-si, Gyeonggi-do, Republic of Korea (hereinafter “Bucketplay” or “we”, “us” or “our”).

This Privacy Policy applies to Personal Information that we collect from Metaball Players (hereinafter “you”), regardless of the platform you are using, as well as information that we collect automatically.

For purposes of this Privacy Policy, “business partners” means any legal entities with whom we have an ongoing business relationship to provide Metaball.

We act as the data controller in accordance with South Korea`s Personal Information Protection Act (“PIPA”), the California Consumer Privacy Act (“CCPA”) and the subsequent amendments from the California Privacy Rights and Enforcement Act (“CPRA”). As well as the EU`s General Data Protection Regulation (“GDPR”).

1. What is Personal Information?

According to the PIPA and the GDPR, Personal Information are "any information relating to an identified or identifiable natural person. This is, for example, name or address data, telephone number, mobile number, bank details or insurance number. However, Personal Information also includes online identifiers such as your device id and IP address.

2. Legal basis for processing

Our legal basis for collecting and using your Personal Information as described in this Privacy Policy depends on the Personal Information involved and the specific context in which we collect it. Generally, your Personal Information will be collected and processed by us on one or more of the following legal bases:

Your consent, for example, where we have obtained your consent to process your Personal Information for certain activities. You are free to withdraw your consent at any time by contacting metaball@bucketplay.com. If you withdraw your consent, the lawfulness of any processing based on your prior consent prior to its withdrawal will not be affected. Where applicable, we will ask you for your consent to process your Personal Information at the time you provide it to us.
Compliance with contractual obligations. At the time of collection, we will inform you whether providing your Personal Information is mandatory and what the consequences will be if you do not provide your information.
To comply with our legal obligations where other laws require us to process your Personal Information (e.g., commercial and tax laws) or where we need your Personal Information to protect your essential interests or those of another person.
On the basis of our legitimate interests; this includes providing this website and/or relevant services and/or carrying out marketing activities, provided always that the interests or fundamental rights and freedoms do not outweigh our legitimate interests.

3. Information we collect

We may ask you for Personal Information when you

Play Metaball or use our services,
request support or information,
place orders for micro transactions and a season pass,
Participate online or otherwise in marketing, advertising or community activities,
Subscribe to Bucketplay marketing and promotional emails or other materials,
Interact with us on third-party social networking sites (subject to the terms of use and privacy policies of said third parties); or
Contact us

Categories of Personal Information we collect may include your ID, unique identifier, Profile Photo. It may also include payment confirmations not actual payment data. If you contact us, we process the following data from you for the purpose of processing and handling your request: first name, last name, e-mail address, and, if applicable, other information if you have provided it, and your message. We may also ask you for other information that we need to process your enquiries.

In order to provide you with a more consistent and personalized user experience in your interactions with Bucketplay, data collected through one source may also be linked to other data collected by Bucketplay through other sources.

This may include data that helps us identify you when you access Metaball through several different devices. We may also enrich the data we collect with data obtained from other parties, such as our business partners or other third parties including PlayFab and Xbox operated by Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA; or Steam operated by Valve Corporation, P.O. Box 1688, Bellevue, WA 98009, USA; or Playstation operated by Sony Group Corporation, 1-7-1 Konan Minato-ku, Tokyo, 108-0075 Japan; or Nintendo operated by Nintendo Co., Ltd, 11-1 Kamitoba Hokodatecho, Minami Ward, Kyoto, 601-8501, Japan

4. Our use of Personal Information

Bucketplay may use your Personal Information for the following purposes:

Providing you with Metaball, our services and support, and conducting transactions you request,
Sending notifications to you, including information about the status of your transaction, including information about the services as well as order confirmations, about specific Bucketplay programs in which you may wish to participate, and about services available from Bucketplay,
Enabling you to use Metaball,
Providing support to respond to your inquiries,
Customize, analyze and optimize our solutions, services (including content to gauge usage trends and determine the effectiveness of our marketing and advertising campaigns), technologies, notifications and business relationships with you,
Marketing and Advertising
Better understanding our clients and users,
Personalizing content and implementing your preferences,
Enforcing our terms and conditions, and separate contracts (if any) with you,
Prevention of fraud and other prohibited or unlawful activities,
Open communities (online gaming sessions and social networking services), tournaments or online game events participation,
Improve our Services,
Protecting the security and integrity of Metaball, our businesses, and services; and
Other functions and purposes disclosed to you at the time of collection or as required or permitted by law.

5. Retention of your data

We will retain your Personal Information as necessary in connection with the purposes described in this Privacy Policy, for as long as you are actively working with us, and in accordance with South Korean Retention Periods and other applicable laws.

6. International transfers

Bucketplay may transfer your Personal Information to other companies and/or business partners as necessary for the purposes described in this Privacy Policy. In doing so, your Personal Information may be transferred to countries outside South Korea, including countries outside the European Economic Area. In order to provide adequate protection for your Personal Information when it is transferred, we have contractual arrangements regarding such transfers. We take all reasonable technical and organizational measures to protect the Personal Information we transfer.

7. Sharing of Personal Information by us

We may share your Personal Information publicly, with Bucketplay affiliates and business partners for the purposes described in this Privacy Policy, including, without limitation, to carry out transactions you request or to respond more quickly to your needs.

We will only share your Personal Information with Bucketplay affiliates and business partners who have agreed to protect your Personal Information and to use it only for the purposes Bucketplay has specified.

With your consent, we may disclose your Personal Information for any purpose.

In addition, we may disclose your Personal Information: in connection with law enforcement, fraud prevention or other legal proceedings; as required by law or regulation; if Bucketplay (or a part of Bucketplay) is sold to or merged with another company; or if we have reason to believe that disclosure is necessary to protect Bucketplay, its clients or the public.

In all cases other than those described above, Personal Information will not be disclosed by us to third parties for their own marketing purposes without your consent.

8. Updating your information

If you believe that the information, we hold about you is inaccurate or that we are no longer entitled to use it and want to request its rectification, deletion, or object to its processing, please do so by contacting us using metaball@bucketplay.com.

9. Access Request and updating your Personal Information

In the event that you wish to make a Data Subject Access Request, you may inform us in writing of the same using metaball@bucketplay.com.

We will respond to requests regarding access and correction as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will inform you in writing within thirty (30) days of the time by which we will be able to respond to your request. If we are unable to provide you with any Personal Information or to make a correction requested by you, we shall generally inform you of the reasons why we are unable to do so (except where we are not required to do so under the respective legal regulations mentioned above).

Marketing-related emails are sent to your email only when you suscribed. If you wish to withdraw from marketing-related content, please contact metaball@bucketplay.com.

13. How we protect your Personal Information

Bucketplay takes all reasonable steps to protect your Personal Information from misuse, alteration, and loss, and from unauthorized access, alteration or disclosure. To this end, we use the following means, among others:

Use of encryption when collecting and transmitting data, technical and organizational measures to ensure the continuous integrity, availability and fail-safety of processing systems and services,
Restricting physical access to our sites and facilities,
Restricting access to data we collect about you,
Ensuring appropriate safeguards are in place at our facilities and those of our business partners to ensure the security of your Personal Information; and,
where required by law, deleting or anonymizing Personal Information.

Nonetheless, databases or data sets that include Personal Information may be breached inadvertently or through wrongful intrusion. Upon becoming aware of a data breach, we will notify all affected individuals whose Personal Information may have been compromised, and the notice will be accompanied by a description of the action being taken to reconcile any damage as a result of the data breach. Notices will be provided as expeditiously as possible after which the breach was discovered.

14. Collection and Use of Children's Personal Information

Bucketplay takes the privacy of children very seriously. We do not knowingly collect Personal Information from children under the age of 13. If you are underage, please do not send us any information about yourself and you should not use or attempt to use our Services. If you suspect that a user is under the age of 13, please contact us at metaball@bucketplay.com. We encourage parents and guardians to take an active role in their children's online activities and interests to protect them.

15. Changes

We may update this Privacy Policy from time to time. If we make changes to this Privacy Policy or materially change Bucketplay's use of your Personal Information, we will revise the Privacy Policy accordingly and also change the effective date at the end of this section. We encourage you to periodically review this Privacy Policy to be informed of how we use and protect your Personal Information.
